Cellular Mobile Services including GPRS and MMS (the "Facilitiy(ies)") are communication facilities intended for use in a lawful manner and for lawful purposes. The Facility(ies) should not be used for any objectionable or illegal activity or purpose including but not limited to transmission or publishing or viewing of any data image or other material which is lascivious, prurient, obscene or tending to deprave / corrupt (the "Illegal Activity(ies)").
Recognising that it is not possible for Idea Cellular Limited to control the purpose for which the Facility(ies) may be used or to filter any data image or other material transmitted / disseminated / published / viewed using the Facility(ies) the Subscriber, as a condition precedent to the activation of any of the Facility(ies) agrees:
1. Not to use any Facility(ies) for or in connection with any Illegal Activity(ies).
2. To indemnify Idea Cellular Limited against and in respect of all consequences including but not limited to damages, fines, penalties, costs to which Idea Cellular Limited may be exposed by the Subscriber's use of any of the Facility(ies) for or in connection with any Illegal Activity(ies).
3. That Idea Cellular Limited may terminate / withdraw all or any of the Facility(ies) without notice to the Subscriber if it is reported that the Subscriber has used any Facility(ies) for or in connection with any Illegal Activity(ies)
4. Idea Cellular Limited will not be liable for any consequences of or following such termination.
5. Such termination will not entitle the Subscriber to any refund; and
6. The Subscriber will remain liable to pay for all usage of the Facility(ies).
